DATED 3RD FEBRUARY, 2009 P.C. Heard the learned Counsel appearing on behalf of the Applicants and the learned APP for the State. The Applicants are arrested in connection with an offence punishable under sections 143, 147, 148, 149, 302, 324,504 of the Indian Penal Code registered at Kolshewadi Police Station, Kalyan (East),Dist. Thane on 20.3.2008. The chargesheet has been filed. It is alleged that the Applicants along with others had assaulted the Complainant and others with sticks and, as a result, one Gopal Dhumal had received injuries and he thereafter, succumbed to the injuries on 22.3.2008. In the first information, it has been stated that some unknown persons have assaulted the deceased and others. Perusal of the material, which is on record shows that there are contradictions in respect of the statements of eye witnesses. Exact number of persons, who had assaulted the complainant and others differs from witness to witness. No specific role, otherwise, has been attributed to the present Applicants. Applicants have not been identified by the Complainant since no identification parade has been held by the Investigating Officer. Under these circumstances, in my view, prima facie case is made out for grant of bail. The Applicants be released on bail in a sum of Rs.5,000/- each with one or two sureties in the like amount. The Applicants shall report to the Koleshwadi Police Station, Kalyan (East), Dist. Thane once in a month. Application is disposed of. V.M. KANADE J.

Appeal is allowed. ii. The respondent no. 2-insurance company shall deposit amount of Rs. 34 Lakhs before the Tribunal within two weeks from today. iii. No. 5 of 2020 registered with Shikrapur Police Station, Pune Rural for offences punishable under Sections 306, 504, 506 r/w Section 34 of Indian Penal Code. By order dated 9th January, 2020 the learned Special Judge had declined to grant interim protection to the applicants. However, the other accused were granted interim protection. The order further indicates that the accused-applicants were directed to remain present before the Court till the disposal of the main application. Learned Counsel for the applicants submits that, in the event the applicant remains present before the Sessions Court, there is apprehension of their arrest. It is further submitted that the applicant No.1 is pregnant lady. It is also submitted that the applicants are having similar role with other accused who were granted interim protection. The case before the Sessions Court for hearing the application is tomorrow. Considering the aforesaid circumstance, interim protection can be granted to the applicants pending their application before Sessions Court. O R D E R i) In the event of arrest of applicants in C.R. No. 5 of 2020 registered with Shikrapur Police Station, Pune Rural, the applicants be released on bail on furnishing P. R. Bond in the sum of Rs.25000/-, with one or more sureties in the like amount; ii) This interim protection shall operate till the disposal of the application, pending before the Sessions Court. It is made clear that this court has not adjudicated merits of the case and the Sessions Court shall deal with the application in accordance with law. iii) Application stands disposed of accordingly.
