Affidavit-in-reply is filed on behalf of respondent no.1 through Mr. Shravan Shrirang Kshirsagar, Sub-Divisional Officer, Mangalwedha, Dist. Solapur. Paragraph 9 of the reply states as under:- " With reference to para no. 12 of the P.I.L., I say and submit that the contents of the said para are not true and correct and not admitted by the Respondents. I say and submit that Respondent No.11 was found excavating and from the sathas with the help of boats, suction pumps and with the help of other machines during the period 30.3.3015 to 17.04.2015 and this fact was noticed by the Tahsildar, Mangalwedha, and imposed a fine of Rs. 2,06,43,000/- upon the Respondent No. 11." In view of this statement made on oath we direct the Collector, Solapur to take urgent, stringent steps to prevent any party including respondent no.1 from excavating sand with the help of boats, suction pumps and with the help of machines which are not permitted under the policy of the State. The Collector is directed to take appropriate decision in accordance with policy of the State. We further direct the Collector to call for explanation from the subordinate officers in respect of alleged illegal excavation. Learned Counsel appearing for respondent no.11 seeks sometime as copy of the petition has not been served on him. Stand over for two weeks. P.C. : Learned A.G.P. submits that consequent to the orders passed by this Court illegal excavation of sand has been prevented due to intervention of Collector, Solapur. It is submitted that the Collector has taken serious note and imposed fine of Rs.2 crore against the persons excavating sand illegally. We direct the Collector to monitor as to whether such lapses are occurring in any other parts of the district. The officers, who are deputed to visit site, shall be given adequate police protection of armed guards. We direct the Police Commissioner, Solapur to provide necessary protection to such officers on the request made by the Collector. An affidavit be filed in respect of steps taken consequent to the orders passed by this Court. Stand over for two weeks, i.e. 31st July 2015. H.B.
