The case of the Respondent No.2 is that the cheque bears the signature of the Petitioner and it was given by the Petitioner to Respondent No.2. 4 In view of the statement of the learned counsel for the Respondent No.2, it is not necessary to discuss the order of the learned Magistrate in detail.
