INTERIM APPLICATION NO.3895 OF 2023 IN CROSS OBJECTION (ST) NO.4340 OF 2023 This is an application seeking condonation of delay of 500 days in preferring the Cross Objection in the First Appeal No.133 of 2021 which has been dismissed for failure to file paper book in time. Mr. Rajesh Kanojia, learned Counsel for the applicant submits that if Mr. Yogesh Pande, learned Counsel consents to allow the condonation of delay for restoration of the First Appeal then he has instructions to consent for the condonation of delay in filing the Cross Objection so that both the First Appeal and the Cross Objection can be heard on the same date on merits. Mr. Yogesh Pande, learned Counsel states on instructions, that pursuant to the dismissal of the First Appeal the original claimant has already withdrawn the entire amount and would submit that in the Lower Court when the amount was allowed to be withdrawn, the Advocate or Representative of the Insurance Company did not object to the same.
