With the consent of learned counsel appearing for the parties, heard finally. It is common contention of the learned counsel appearing for the petitioner and respondent No.2 that the parties have amicably settled the dispute and to that effect, consent terms are placed on record before the learned Civil Judge, Senior Division, Kalyan. Learned counsel appearing for respondent No.2 had tendered across the bar, affidavit of respondent No.2. Same is taken on record. In the said affidavit, details of the settlement are averred. Respondent No.2 is present before the Court. She has been identified by her counsel. She has stated that it is her voluntary act to enter into such settlement and pray for quashing of the impugned FIR and proceedings arising out of the said FIR, in view of the consent terms filed before the court of Civil Judge, Senior Division, Kalyan. The Hon'ble Supreme Court in the case of Gian Singh v. State of Punjab and Another 1 has held that, the criminal cases having overwhelmingly and predominatingly civil flavour stand on a different footing for the purposes of quashing, particularly the offences arising from commercial, financial, mercantile, civil, partnership or such like transactions or the offences arising out of matrimony relating to dowry, etc. or the family disputes where the wrong is basically private or personal in nature and the parties have resolved their entire dispute. In this category of cases, the High Court may quash the criminal proceedings if in its view, because of the compromise between the offender and the victim, the possibility of conviction is remote and bleak and continuation of the criminal case would put the accused to great oppression and prejudice and 1 2012 (10) SCC 303 extreme injustice would be caused to him by not quashing the criminal case despite full and complete settlement and compromise with the victim. It has also held that inherent power is of wide plenitude with no statutory limitation but it has to be exercised in accord with the guideline engrafted in such power viz.: (i) to secure the ends of justice, or (ii) to prevent abuse of the process of any court. Since the parties have amicably settled the dispute, respondent No.2 is not going to participate in the said proceedings and chances of the conviction of the petitioner would be bleak and remote and, therefore, further continuation of the proceedings in RCC No.730 of 2017 pending before the Judicial Magistrate First Class, Kalyan for the offences punishable under Sections 498-A, 495, 504 of the Indian Penal Code, would be an exercise in futility and would tantamount to abuse of process of the Court. In that view of the matter, to secure the ends of justice and to prevent the abuse of the process of the court, the petition deserves to be allowed. Accordingly, the proceedings bearing RCC No.730 of 2017 pending before the Judicial Magistrate First Class, Kalyan for the offences punishable under Sections 498-A, 495, 504 of the Indian Penal Code are quashed and set aside. Respondent No.2 had filed proceedings under Section 125 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') before the trial Court. By order dated 12.04.2010, maintenance @ Rs.1,300/- per month with effect from 10.06.2008 was awarded to the respondent No.2. Respondent No.2 thereafter filed proceedings under Section 127 of Cr.P.C. for enhancing the maintenance amount. By order dated 30.05.2016, the learned Judge, Family Court No.3, Mumbai allowed the Petition and directed the petitioner herein to pay enhanced maintenance @ Rs.12,000/- per month to the respondent No.2 from the date of the Petition i.e. 17.04.2014. Ms Devkar, on instructions, states that petitioner has paid the maintenance from 17.04.2014 till June, 2018 @ Rs.12,000/- per month as per the order dated 30.05.2016. From July, 2018 onwards, he has not paid the maintenance as he has filed proceedings for cancelling the maintenance amount from 30.04.2018 on the ground that petitioner has attained superannuation. On instructions, she further states that before the next date of hearing, petitioner will deposit the arrears of maintenance of Rs.84,000/- (from July 2018 to 28.02.2019 @ Rs.12,000/- per month) in this Court. In view thereof, list the Petition for 'admission' on 14.03.2019 in the Supplementary Board. Till next date, subject to the petitioner depositing Rs.84,000/- in this Court before the next date of hearing, order dated 04.12.2018 issuing distress warrant against the petitioner herein is stayed. No coercive steps shall be taken against the petitioner till next date. It is further made clear that in case the petitioner does not deposit arrears within the stipulated time, this protection shall stand vacated without further reference to the Court. (R. G. By this Application, the Applicant is challenging the order dated 5th December, 2013 passed by the Metropolitan Magistrate, 52nd Court, Kurla, Mumbai, below Exhibit 4 in C. C. No. 189/Misc/2013, by which, her application came to be rejected, wherein she had challenged the locus standi of the Respondent No.1 to file an application under the provisions of the Protection of Women from Domestic Violence Act, 2005. The present Applicant is the daughter-in-law of the Respondent No.1. The Respondent No. 1 has filed an application under Section 12 of the Protection of Women from Domestic Violence Act, 2005, seeking reliefs under Sections 18, 21 and 22 of the said Act, and has also sought protection order apart from other reliefs. The learned Counsel for the Applicant has relied on a Judgment of the Delhi High Court in the case of Varsha Kapoor vs. Union of India & Ors. in Writ Petition (Criminal) No. 638 of 2010, in support of his contention that the term `respondent' as defined in Section 2(q), is restricted only to adult male persons while construing the expression, "a relative of the husband or the male partner." Issue notice to the respondent No.1, returnable on 11th February, 2014. Hamdust permitted. In addition to Court notice, Applicant to serve the respondent No.1 by Advocate's notice and file an affidavit of service before the returnable date. The learned Counsel for the Applicant, on the instructions of the Applicant, who is present in Court, states that she will not visit the house of respondent No.1 or create any nuisance or threaten the respondent No.1.
