Appellant - State takes exception to the order passed by the Judicial Magistrate, First Class, Ajara whereby the accused were acquitted of the offence punishable under section 153-B and 143 of the Indian Penal code. International one day Cricket match was held at Sharijah on 23/10/1991 between India and Pakistan and, in the said match, the Indian Cricket Team was defeated by Pakistan and it is alleged that the accused alongwith others celebrated defeat of the Indian Cricket Team at the hands of Pakistani Cricket Team and they shouted slogans and burst fire crackers. The trial court has considered the evidence on record and came to the conclusion that the prosecution has not established its case against the accused. I have perused the impugned judgment and order as also notes of evidence shown to me by the learned APP for the State. In my view, there is no infirmity in the order passed by the trial court. The judgment of the Supreme Court in Balwant Singh and another Vs. State of Punjab reported in AIR 1995 SC 1985 squarely applies to the facts of the present case. The Apex Court in the said judgment has observed that raising of some slogans, a couple of times by two individuals, without anything more, did not constitute any threat to the Government of India as by law established nor could the same give rise to feelings of enmity of hatred among different communities or religious or other groups. Leave is therefore refused. Appeal is dismissed. (V.M. KANADE, J.)

The applicant is shown as an accused alongwith another person in C.R.No.149/2006 registered by the Goregaon police station for offences under Sections 465, 467, 468, 420, 380, & 408 r/w 34 of IPC. The applicant was working as a peon in the office of the Complainant and he said to have stolen blank cheque and handed it to the co-accused who forged it and encashed it for the amount of Rs.1,82,000/ An : 2 : amount of Rs.1,71,800/- is recovered. This applicant is a peon and is arrested on 1.5.2006. Investigation is completed. In my view bail can be granted to the present applicant. It is therefore, directed that pending his trial in connection with C.R.No.149/2006 registered by the Goregaon police station, the applicant may be released on bail in the sum of Rs.5,000/ with one surety in the like amount subject to the condition that he will report to the Investigating officer once a month on every Monday till the disposal of the trial. Applicants apprehend arrest in connection with the offence punishable under sections 406, 420, 467, 468, 471 read with section 34 of the Indian Penal Code. It is alleged that the present applicants have defrauded depositors to the tune of Rs 8,27,27,308/. In the affidavit in reply filed by the State it is stated that loans have been given to fictitious and bogus persons who are not in existence. Taking into consideration the allegations which are levelled in the complaint and the affidavit in reply filed by the State, no case is made out for grant of anticipatory bail. Both these applications for anticipatory bail are accordingly rejected. Both these applications are disposed of. (V.M. KANADE, J.)

This is an application under section 439 of the Code of Criminal Procedure for grant of bail. I was taken through the statements made by one Mahendra Somnath Yadav and Smt.Radha Shrikrishna Wankhede who have graphically described the role of the applicant in the commission of the offence. At this stage, prima facie, it is not in dispute that the prima facie material showing positive role of the applicant in commission of the offence charged is available. The possibility of tampering with evidence and pressuring prosecution witnesses expressed by the learned Sessions Judge in order dated 2nd July 2007 while rejecting the bail application, that the applicant Sunil Chandanshive, if released on bail, cannot be ruled out. It gets strength from the character of the applicant which can be seen from the record. In the above view of the matter I am not inclined to grant bail. However, hearing of the trial is expedited.
