C. :- The Court of the JMFC has convicted the accused personsaccused Nos. 1 and 3 for the offence punishable under Sections 326, 324 and 323 read with 34 of the Indian Penal Code as per judgment dated 07/10/2014, at page no. 53. Their appeal was partly allowed by learned Sessions Judge, Nashik on 03/05/2017. The conviction of the accused nos. 1 and 3 for the offence punishable under Section 326 read with 34 was set aside. Whereas it is maintained for the offence Section 324 read with 34 of the Indian Penal Code. The accused No. 3 was not directed to undergo sentence immediately but he was asked to execute the bond of good behaviour for the period of two years. That period has already expired. The following issue arisen in the revision:- (i) The legality of the sentence under Section 326 read with 34 of the Indian Penal Code against accused no. 1.
